GuardNet, Inc. Limited Warranty

In addition to the manufacturer’s warranty, GuardNet, Inc. warrants the hardware products it uses will be free from defect in materials and workmanship. The limited warranty term is 30 days beginning on the date of invoice. After 30 days, GuardNet, Inc. will send defective materials to the manufacturer. Processing will be dependent upon the manufacturer’s warranty.

This limited warranty does not cover damage due to external causes, including damage resulting from accidents, abuse, misuse, problems with electrical power, servicing not authorized by GuardNet, Inc., usage not in accordance with product instructions, failure to perform required preventive maintenance, problems caused by parts and components not supplied and installed by GuardNet, Inc., third party software, applications and external devices not supplied by GuardNet, Inc., or software downloaded from the internet.

Return Policy

Because GuardNet, Inc. custom orders all products based on customer need, returns are not allowed after the order has been placed.

Terms of Payment

Payment is due on receipt of services performed or merchandise sold unless otherwise stated beneath customer Proposal and Service Agreement Payment Terms. Late payments will receive a finance charge.

Equipment Rental Agreement

Ownership & Use

The Title of the Equipment shall remain with GuardNet, Inc. Renter shall not lease, sublease, rent, lend, sub-rent, transfer, assign, sell, alter, repair, disassemble, modify, encumber or take security interest on equipment without GuardNet, Inc.’s prior written consent. Renter shall use the equipment in a careful and proper manner in accordance with the manufacturer’s instructions and specifications. Renter may not use equipment for any illegal purpose or in an illegal manner. Renter will, at its expense, comply with all applicable laws and regulations pertaining to the use, operation and transportation of equipment and will defend, indemnify and hold GuardNet, Inc. harmless for any loss, liability or expense resulting from actual or alleged violations of such laws or regulations.

Rent

Renter will pay GuardNet, Inc. rent for the equipment in accordance with the amount and terms as noted on the rental invoice.

Rental Period

Renter shall rent equipment for the period of time specified on the invoice. GuardNet, Inc. may terminate the rental agreement upon renter’s breach of equipment rental terms.

Responsibility of Renter

Renter shall be responsible for all damage to the equipment, including damage resulting from accidents, abuse, misuse, problems with electrical power, servicing not authorized by GuardNet, Inc., usage not in accordance with product instructions, failure to perform required preventive maintenance, problems caused by use by parts and components not supplied and installed by GuardNet, Inc., third party software, applications and external devices not supplied by GuardNet, Inc., or software downloaded from the internet. In the event such damage occurs, renter will pay GuardNet, Inc. the full equipment value stated on the rental invoice.

Service

During the rental period, GuardNet, Inc. shall provide repairs on equipment that becomes defective through no fault of renter. In the event of such equipment failure, renter shall contact GuardNet, Inc. immediately and request instructions before returning equipment for servicing. Renter indemnifies and holds GuardNet, Inc. harmless against any loss renter may suffer as a result of the equipment not functioning properly.

Credit

Renter certifies that all credit information provided to GuardNet, Inc. is true, correct and complete.

Attorney’s Fees

In the event it becomes necessary to file legal proceedings to enforce any of the terms or provisions of the Rental Agreement, the prevailing party shall be entitled to recover its attorney fees.
